"We are taking all the legal options available to us before we choose to keep those dogs. That is why we have signed a memorandum of understanding with the Department of Health Services on our commitment to use the dogs," O'Malley said. "(However) while they are being shipped into Oregon, our officers have been notified about this situation.

"If we do choose to keep the animals for our department in the future, we intend to continue to pursue solutions to protect the dogs as humanely as possible."

Since 2014, the Maine Kennel Club has shipped its stray dogs to Colorado under a lease with the Oregon Department of Public Safety, but all proceeds from that sale will go to an animal protection organization.

"Many of these private individuals simply do not have the skills to effectively vet an animal and they feel like they are the victims," said O'Malley.


The state Department of Public Safety is handling these cases by conducting training.

"As the state's law enforcement partners, the Department of Public Safety is the sole provider of medical records for state law enforcement to determine whether an animal is a human or an animal as defined by state law," they said in an open letter before they signed the memorandum of understanding, obtained by CBS News.

All animal welfare and humane society members have come forward to express their concerns.
